Attachment to COC I:  Minimum Contract Requirements

As stated in the Code Of Conduct, all RFCI members will include a written contract for all sales transactions, leasing agreements and stud service. Minimums of a basic contract are included in these by-laws and are found on the RFCI’s website, or can be obtained from the Secretary. Members are free to use their own contract and include details they choose beyond these minimums. Sample contracts for a pet sale, a breeder sale, and a stud service and leasing agreement and altering agreement are available on the RFCI website, or can be obtained from the Secretary. Members are free to use these contracts as their own, or make additions to them. It is very important that each member investigate the rules of their own state, city, and county, and the requirements that they are held to by the laws in their community. RFCI has set forth minimums to pertain to good business practice, but does not encompass local regulations for each member.

Attachment to COC   II       Pet Sale Contract
The minimum pet sales contract will include:

Complete description of kitten/cat to be sold including color, pattern & sex and birth date.
A health record showing all vaccinations and date given, and date when next shots are due.
A guarantee that kitten/cat is healthy and free of all internal and external parasites.
Written instruction on the care & feeding of the kitten/cat
Clear and specific instructions to the buyer of their responsibilities to the breeder concerning any illness.
The time period and procedure of notifying the breeder of any defects or illness that occurs with the kitten/cat.
A clearly defined return policy with a 72 hour minimum.
A minimum of a 1-year genetic health replacement guarantee on ALL kittens, with veterinarian necropsy required.
A strict altering agreement if the kitten has not been altered prior to leaving the cattery. This altering agreement will require the registration papers to be held until proof of altering has been received by the breeder on or before the kitten reaches 9 months of age.

Attachment to COC   III :     Breeder Sale Contract

In addition to the above requirements that apply, a breeder sales contract will include the following:

1. The time frame of when the registration papers will be given to the buyer in writing at the time of the sale. Maximum time should not exceed 90 days.
2. It will clearly state if the cat is being sold with show and/or breeding rights, and explain in detail any traits that might affect its potential.
3. A three-generation pedigree complete with colors and numbers to be given with a breeder kitten at time registration papers are given.
4. It will specify in the sales contract the procedure to follow should the kitten/cat prove to be sterile, in poor health, suspected of having a genetic defect or die unexpectedly.
5. A minimum guarantee of at least one viable litter by the age of 2 years on breeding cats, when bred to at least two different proven cats, or the cat will be replaced, or the money refunded at the seller’s discretion. **A litter is defined as at least 2 viable kittens.
6. A clear policy on what is expected when the breeding cat is no longer needed in the breeding program will be included in the contract. It is strongly suggested that breeding cats be retired into a pet home when they are no longer needed in the original breeding program, and not passed on to another cattery. The minimum contract should state that the breeder of the cat should be contacted before the breeding cat changes ownership.

Attachment to COC   V      Stud Service Agreement

In addition to the above requirements that apply, a stud service or leasing agreement should have the following minimum requirements:

  1. A clear outline for what health tests and results are required by both or either party prior to the cat(s) changing hands. Minimum should be a health certificate, fecal exam and FeLv test.
  2. A clear policy for who is responsible for what fees and expenses, (i.e. food, litter, housing costs, and any medical needs or emergencies).
    A clear agreement for the possible outcomes of the arrangement, (i.e. who is to own the cat(s), the offspring, or what reimbursement is expected with or without viable offspring).
  3. A clear agreement for who owns the offspring, and the options for placement of those offspring.
  4. A clear policy on who is responsible for any shipping or traveling expenses, and who is responsible for the actual transportation of the cat(s).
  5. An agreement on the time frame that this service or leasing is going to take place.
  6. An agreement that both parties will sign all registration forms that are required.
